Reporting of Rape Allegations
- In compliance with the Robert “Robbie” Nottingham Campus Crime Scene Investigation Act of 2004, all 365bet staff and faculty are required by law to report to 365bet Campus Police, for investigation, any information they receive that any degree of rape or sexual assault has occurred on property owned or controlled by the University. The only persons granted an exception to this requirement to report allegations of rape to the police are licensed counselors and licensed medical professionals who have received a report of such allegations while performing their official duties as an employee of the University.
- Unless the victim of a sexual assault does not consent to the reporting of an offense, University Police shall immediately notify the Clarksville Police Department if an 365bet police officer is in receipt of a report from the victim alleging that any degree of rape has occurred on 365bet property. The 365bet Chief of Police shall designate one (1) or more persons who shall have the authority and duty to notify the Clarksville Police Department in his/her absence. In the case of an alleged rape, University Police and the Clarksville Police Department shall jointly investigate the incident. University Police can lead the investigation. The Clarksville Police Department and University Police shall cooperate in every respect in the investigation. T.C.A. § 49-7-129.
- If the victim does not consent to the reporting, the chief security officer or chief law enforcement officer of each institution shall not report the offense to the local law enforcement agency. T.C.A. § 49-7-2207; Public Acts 2005, Chapter 305.
